If I Lose Business Due to Condemnation am I entitled to Compensation?

Hello, my name is Raymer Maguire, I’m a 30 year eminent domain practitioner, and I limit my practice to representing property owners and business interests. And the question at hand is, if I lose business or the ability to operate a business due to condemnation, am I entitled to compensation? The answer is, it depends. To qualify for a business damage claim, the business has to be in place, or considered to be the successor to another business that has been in place, for five years. Number two: it needs to be a partial taking, not a whole taking. Number three: the amount of business damage claims are going to be highly dependent on the length of the lease that the tenant has the right to be on the property and to operate the business.
